Flyer Contract development and Management
6 Contract development Contract development begins with the selection of the product, the target indication, and the definition of the service offering, if the contract offering is characterized by more than just the product. This is followed by an analysis of the indication, the course of the disease, the possible com- plications, the economic framework conditions and the treatment setting established in practice. In this way, the product benefits and the associated outcomes are clearly defined, also in comparison to potential competitors. After the identification of medical, care - relevant and economic framework conditions, a pre - selection of relevant contract models can be made. At the same time, a combined data and literature analysis identifies which in- dication - related direct contracts have already been concluded. Experience has shown that it is useful to identify two to three variants of innovative contract offers. At the end of this pro- cess, a preferred contract construct and a back - up alternative are identified. The final step before finalizing the contract offer is then the skillful legal implementation of the underlying medical - economic construct in cooperation with a competent law firm. Structured interviews, flanked by specific questionnaires and checklists, are used in the contract development. In parallel, a data and literature research and, if necessary, a corres- ponding field research is carried out. Subsequently, the generated contract options are summarized in a strengths and weaknes- ses matrix. From the strengths and weaknesses analysis, possible opportunities and risks for and through the contract model are derived in discussions with the client.
